1. Who owns the copyright for the images?
Randall Perry Photography retains the copyright to all images we photograph.

2. How and where am I entitled to use the photos?
When you pay your invoice you are purchasing the rights to use the photos in specific ways. These usage rights include use in a brochure, on a web site, in a portfolio, for wall display, in local print advertising, or in a newsletter or another in house printed promotional piece. You may also use th ephotos for an editorial piece or for an editorial submission.

3. What uses does my contract exclude?
1)regional or national magazine or newsprint advertising
2)television advertising in any format
3)billboards
4)back-lit trade-show booths
5)vehicle advertising.
For these uses Randall Perry Photography will assess a one-time usage fee based on the specific use of each image, taking into consideration the size of the completed image and the circulation and/or likely audience of the intended media. If your express goal in commissioning the photography is outlined in these exclusions, you can eliminate additional usage fees over the life of the image by purchasing unlimited rights at the date of the shoot for an additional $1,500.

4. What is photo credit and how should I use it?
When you use any of the images for publication, in advertising, editorial, a brochure, etc., our contract requires you to provide photo credit. Photo credit is simply a line inconspicuously run along the side of an image stating Randall Perry Photography. If an image is run without appropriate photo credit, Randall Perry Photography reserves the right to charge a usage fee.

5. Who is entitled to use the photographs once they have been taken?
The client who commissioned the photography is entitled to the uses outlined above. Any other party who wishes to use the images for any purpose will be required to pay a usage fee, assessed by and payable to Randall Perry Photography based on a one-time, specific use.

6. Id like to split the cost of the photo session with another company, is that acceptable under the terms of my contract?
We understand that many clients like to share the expense of photography and are more than willing to work with multiple clients on a shoot. There will be an added fee of $500 for each additional client to cover our administrative expenses, creative fees to meet the expressed goals of each different party, and the additional usage rights.

7. What will I get to keep after the photo shoot?
Randall Perry Photography will retain and store the original photography on your behalf. We will provide you with a contact sheet with all the images we have taken, coded with our in-house job number to facilitate your photo orders. We are also happy to forward your originals as necessary for publication and printing purposes, with the express intent that they be returned to our studio immediately following publication. We will assess a fee of $1,500 for each image that is lost or damaged while in your possession. If you would like to keep your original photography, you must purchase unlimited usage rights for $1,500 and we will remit the material to you.

8. Can I have the originals to scan?
You may scan the originals for any of the uses that you have purchased the rights to. Original photography must then be immediately returned to our studio, as outlined above.

9. How do I get prints or other materials made?
We are happy to order materials for your use directly from a custom photo lab where we have a long-standing relationship. Using our job-number code on the back of the contact prints you are provided, call or fax your order in to our studio and well provide a cost breakdown and facilitate your order. This enables us to monitor and ensure the highest quality reproduction of your project and our work.

10. What is your billing structure?
Fees and expenses on our invoices are broken into two areas:
* Creative Fee ( to be estimated once shot list is finalized)
* Expenses:
* Production crew
* Film/Prints/Digital Expenses
* Location and Travel Expenses
In addition, any shoot that extends beyond the anticipated time-frame, or 10 consecutive hours for a one-day shoot, will be billed an additional $150 per hour to cover the photographers expenses.

11. What is your payment schedule?
One-third of our estimate is due at the time of contract signing and one third is due on the day of the shoot. The balance of the total invoice, including all expenses and any additional fees, is due within 30 days of the shoot.

12. What if I need to cancel or reschedule a shoot that I have booked?
A scheduled shoot that is cancelled at least 48 hours prior to the date will be billed at 50% of the photographers fee, plus any expenses we have incurred on the project. A cancellation within 48 hours of a scheduled shoot will be billed at 100% of the fee as it may be impossible to book additional work with such short notice.

13. What happens when my project is weather dependent?
If you decided to cancel or postpone a shoot due to poor weather once we have arrived on location, either before shooting begins or after we are already underway, you will still be responsible for 100% of the fee, plus any expenses incurred. A weather cancellation or postponement prior to our leaving our studio will result in a charge of only 50% of the fee. There are many shots that can be taken and look great, even on a marginal day. Every situation is unique, however, you may be surprised to learn that many shots look as good or better without bright sunlight.

14. Do I have to be present at the shoot?
You do not have to be present at the shoot, however, we do recommend that you or a representative be at the job-site to approve final photo angles, etc. If you or a representative are not present, we will do our best to interpret your goals for the photo shoot and use our best judgement in assessing the shots. We frequently scout projects in advance of the final shoot using 35 mm prints or slides to specifically nail down angles in advance. This additional service is available for $75/hour.
